Foreclosures Forcing Out More Renters: Orangevale Tenant Says He Wasn't Told Of Situation

 A new report shows that about 1.7 million homeowners were on the verge of foreclosure this autumn.

The fallout from the crisis is affecting people who don't even own homes, as more renters are facing foreclosure evictions.

Sean Vreeland made a work-related move from Pasadena to Sacramento this fall.

He's employed to inspect foreclosed homes -- but he never expected to be living in one.

"On Nov. 30, a foreclosure notice was posted on my door," Vreeland said.

He rented a duplex in Orangevale through Homepointe Property Management on a month-to-month agreement. The home was part of a lawsuit and in receivership.

The owner defaulted on it in January, but Vreeland said Homepointe didn't tell him about the situation.

Vince Dizon with the Fair Housing Commission said landlords don't have to disclose that information to tenants.

"Right now, there is no law out there that says that in every situation, a landlord must disclose that he is in jeopardy of foreclosing," Dizon said.

Homepointe refused KCRA 3's request for an on-camera interview. However, the company gave a statement about the foreclosure: The property manager is "not involved in this process" and "not informed when this happens."

"There was no material deception since the tenant has rented the property under a valid rental agreement," according to the statement.

The duplex is scheduled for auction later this month, and Vreeland doesn't know if or when he'll be forced to move.

Vreeland said other renters should be very careful and should ask if the home is in foreclosure before moving in.

Homepointe is still advertising the other half of the duplex for rent, but said it will disclose the situation to any applicant.

To protect your rights as a renter: Ask a landlord if the property is in jeopardy or foreclosure, check with the county recorder's office to see if foreclosure papers are filed, and if a home changes hands due to foreclosure, a new federal law requires the new owner give 90 days notice to end the tenancy.
