Update to Foreclosure Hell.
On May 12th some party unknown crept up to our door and taped a Notice To Quit our front door. They didn’t even have the nerve to knock on the door and deliver it to myself (disabled in wheelchair) or my 84 year old mother as we were both home watching TV at the time. The notice was kind of generic as it listed 3 types of notice, 3day – 30day - & 60 day. I guess they still don’t know who is living here as they continue to think that the original landlord lives in one of the Four single family dwellings.
Unfortunately this notice came a week before Obama signed into Federal Law the new 90 day notice required on the no-fault evictions that are happening to so many here in California. So as I read it we now have till July 7th to find a new place to rent.
We have a friend who continues to try to buy the property but the realtor he’s going through says the bankers (Sutton Funding LLC / Country Wide Home Loans) won’t even put the place on the market till all the renters are out.
We tried to get financing to buy a place but didn’t qualify for the FHA loan as they require a least a 620 credit score. So we are looking for a place for the 3 of us and the 2 ponies and 2 cats. It’s an uphill climb and very little light at the end of the tunnel.
Then there’s the Small Claims court hearing on June 8th where we’ll be trying to get our $1500.00 security deposit back from the foreclosed landlord. I saw him a couple of weeks ago when he came out to see if we were still living here. He stated to me since we haven’t left we aren’t entitled to the money. I stated to him since he no longer was the owner of the property it was his morale if not legal duty to refund the money. I guess it’ll all be decided in court with the judge.
