My landlord didn't return my security deposit after I moved out. I left VM and requests per email in regards to the deposit. He never responded. I sent him the CA tenant laws and one month later after move out date I rcd a check minus deductions. The deductions were unreasonable. The carpet was dirty when I moved in-it was about 20ftby 14 and he charged $350 normal charge is $100. A cracked window the bldg is 70yrs old and the crack was probably caused by the wind. He states the tub was clogged in which it wasn't. Claims a missing curtain and unit didn't have a curtain when I moved in. My understanding is I can take him to court to receive the full amt since he was not within the 21 days and request the invoices for repairs. What is the best way to approach the matter. Send a demand letter for full amt since he was 9 days late and never responded to my requests. If he doesn't respond, I shouldn't cash the securtity deposit and take him to small claims court and sue for the three months due to bad faith? Any feedback-the security deposit was $1500 and he charged 1100 in repairs-I had advised him of the cracked windows and the rug which was about 30 years old-I used throw rugs over the old rug-
