I have been renting a mobile home on 11 acres for the last 7 years. I rented it in good faith from the landlord. Just recently, as a result of the well collapsing on the property, and the landlord do nothing to fix or repair it. Leaving us to obtain our own water for the last 11 months. Purchasing 55 gallon drums to transport the water & 250 gallon tanks to attach to the house to have running water. We paid our full rent the entire time as she kept demanding it. A call was made to Code Enforcement because the well had not been replaced. At that time, we found out the the mobile home on the property that we were living in, was illegal and not even supposed to be on the property. We have since had to move out because the landlord wanted to sell the property. She just wanted us out so she could move in. The county sent her a letter stating that the mobile was to be vacated and remain vacated if she wanted to apply for another permit. The house is full of her furniture & she has been living there. Question we have, we want to sue for our rent that we have paid this last 7 years. The California Civil Code clearly states that a landlord cannot make a financial gain on renting illegal property. The county is going to prosecute but we want to go after the rent we have paid. And ideas?
