We moved into this house on 2/15/08. We had a choice to pay cashier's check or direct deposit, we chose direct deposit. Since he lives out of state I thought it best to pay via direct deposit. We explained to the landlord that I get paid every 2 weeks, in a years period he would get 13 months worth of rent. We agreed he would return the extra checks than to stop the direct deposit. This past year I got paid extra in August & January. In December when my husband inquired about how to utitlize our extra months rent he came up with "oh, I see what kind of tenants you are, remember you still owed me for the move-in deposit & this is what I get being a nice guy"! Since I couldn't find the agreement I couldn't argue. Since I found the rental agreement I pushed the issue again to the point my husband refused to talk to our landlord stating he is too difficult to deal with. He gets enraged. I called the landlord & told him that I am stopping the direct deposit & that I'll pay him his rent on the 1st, he left a nasty message saying if we are going to be like that, that he would stick a for sale sign on his front lawn. I reinstated my direct deposit, to keep the peace. We got a notice 6/5/09, looks like a fake court documents stating we have 45 days to move out or purchase the home. My husband & I talked it over & on 6/17 I called our landlord to clarify the letter. He told me that since we do not cover the whole mortgage note that he had exhausted his savings and needs to sell now. I told him that I want to buy & that I will pay on the 1st, which he's ok with. When we got to what month we are on rent wise he was enraged, he told me that he no longer wanted to speak to me and to put my husband on the phone. My husband was standing 5 feet away and could hear him yelling at me. My husband said that he would talk to him once things calmed down. He told me "tell your husband to grow some balls and put him on the line", when he refused he got even more belligerant "that's right thats my house and that you all are trespassing and that I am going to evict you and I am going enjoy it, you are going to pay me my rent". He hung up on me stating you better get ready because I am on my way. By the time I hung up with him my hands were trembling. Being that I never saw this side of him I called the police to make some sort of paper trail as to my dealings with the landlord. I got an incidnent report. The agreement mentions nothing of us owing money. How do I get credit for the extra checks & can he evict us? Can I sue him for harassment? He also is telling the neighbors that we are 3 months behind in rent and that I am a snake!
