We paid our rent and had a 1 year lease until Aug 20, 2010, with the option to buy. WITHOUT A COURT ORDER,Washington Mutual locked us out of our home, unlawfully evicting a single mother and son. Without any relocation services, without giving the deposit back within 21 days. Since then, everything in the home has been stolen. We are now homeless

I signed a one year lease option in July 2008 for 383 Calypso Beach Drive Copperopolis, California 95228,Calypso Bay Sub Division, and on August 20 2008 we moved in as scheduled.

Soon we found out our home was one of
many homes in the Calypso Bay sub division that were foreclosing. In December of 2008, the house was scheduled for auction, I obtained the contact information of Vicky Grimm at Quality Loan Servicing Company called her at (904) 886-6087, to let her know we existed, and we had a 1 year lease option. I also let her know the water had been shut off due to non-pay (previous renters usage), I continued on to say that we were without water for the second time, Calaveras water district would not open a fresh account until past due bill was paid. Who should I contact? She told me to call Vicci Fikes of Tri Dam Realty, she would get the water restored. We hung up and I immediately called Vicci Fikes of Tri Dam Realty at (209) 920-1520 about 4:00pm. We spoke briefly but she wasn't too concerned about the water, I explained that I needed the water to be turned on, if not then I would have to stay in San Jose until then, I couldn't stay in the house without water again, and it was approaching 5:00pm( according to my neighbor they came late, at 9:30pm, but I was already in San Jose). I called Vicci Fikes when I returned, I left a message but didn't hear from her again until Feb 2009. That is when a "NOTICE TO VACATE"-SEE ATTACHED- was taped to my front door. That would have allowed me April 5 2009 as a move out date. I didn't understand so, I called an acquaintance and Real Estate agent in the area , Sue Andrus of California Properties, I asked her to call Vicky Grimm at Quality Loan Servicing company to see what she could do, she did, and when Sue called me back , she said that Vicky Grimm of Quality Loan Servicing Company wanted us out, and that a sheriff would be at my door Feb 5 2009. I had to get out. Why? Was this retaliatory? Why was she mad? I then called her myself and found that she was cold and unconcerned that this was our home, we had a 1 year lease option to buy or that my son and I had nowhere else to go! Her exact words " Go to San Jose, you seem to have a place there". She felt I wasn't doing my part, when they had the water turned on. I told her I had a party for my son that day and it was almost 5 o'clock on a Friday. The water company wouldn't come out over the weekend! I had to leave that day! I cried and asked her to please honor my lease, I would continue to pay rent (as we were), and would soon be able to buy the home! I just needed more time. Her words were, "you need to be out in a couple days, by Feb 5, 2009”.
I gathered our old pictures and some clothes. Before leaving that day I wanted to see how heavy my cherry credenza was, and if I would be able to move it myself. I pulled a small muscle in my back doing so. I knew that I obviously needed to come back for my furnishings. I left a key under the front door mat, telling only my friend, Sue Andrus. The next day, I received a call from Marko, my neighbor (209 988-7926), he said someone was at my house taking things out so. I called the neighbor that lived behind me, Michelle Edwards, and she went over to my house immediately telling the people the police are coming, Erin still lives here , if anything is missing, it was stealing, so they left. At that point, Sheriff Tyson (209) 605-8249 pulled up to my house. He witnessed the situation and got on the phone with me and gave me his phone number. I told him I would be coming up to the house after my back felt better, I would call him if anything was missing. We went to the house after Feb 14, 2009 and could not get into my house, the locks had been changed,. Vicci Fikes sent me a letter(attached) dated 2/19/2009- stating I had 18 days to retrieve my things,. I called her telling her I still had right to this house, I was not wanting to move, I would be buying it soon but was anxious to get into my house to see if there was any damage and if anything was missing. We agreed to meet on March 6, 2009 between the hours of 10:00 am -12 noon. Early morning on March 6 2009, I realized that I would not be able to accommodate the time that we had set and needed to reschedule.I called her 4 or 5 times, I was not able to reach her, only her voicemail. I told her on her voicemail that I have the the right to enter my house for the next 60 days, please call me back. I then called the Law firm listed on the "notice to vacate",The Endres Law Firm at 530 601 5166. I told themthe same thing, that I needed the keys, to my home and I needed Vicci to call me asap. They thought the case was closed. I told her it wasn't. I have still not heard back from anyone listed above, nor has my deposit been given back to me, we are homeless and afraid.

I then emailed senator and congressman and let the asset manager aware. The bank gave me possession of the house April 20,2009. The gas was off! once again, we left to S,J ,came back the next weekend to fing a nother BOTICE TO VACATE ON THE DOOR. My son and i just cried...

I asked them again to please give me the asking price on the house, and they said , after I give them a Pre-apptroval letter. WHAT IS GOING ON HERE?!!
