We have been renting a home in Carlsbad, CA since June 2008. The home is in foreclosure and scheduled for auction (2nd time in ten months) on 7/14/2010. With our original lease contract, we paid upfront first months rent, last months rent and a security deposit. Our landlord refuses to provide us with any written information or verification that she has or is able to postpone the auction. She says that she has a "verbal agreement" with the bank and has nothing in writing to offer us. We fear that if we do, indeed, pay rent for July 2010 the house will actually sell at auction and we essentially are out two months rent (remember we paid our last months rent upfront in 2008). The landlord is demanding rent in two days or she will begin charging late fees. This is very upsetting as we simply would like to have some type of verification that she is able to delay the sale before we pay her a dime. We don't trust her and know that if the auction sale goes through, she will never give us our deposit back. We have searched the internet for days hoping to find any information identical to our situation to no avail. We do not feel it is fair for us to pay her rent if she will not provide us with some type of auction cancellation proof. The law in this area seems so vague and we feel completely intimidated by our landlord. This is so unfair.
