Carla

well the property that we are renting was recently sold from a foreclosure without our knowledge. the previous owner collected rent for november and now the new owner is threatening to evict us if we don't pay rent for nov again to them. He doesn't even have the title yet and is wanting to kick us all out and i know i must have some rights as a tenant.

This is the 3rd house in 3 years that we have rented and gone into foreclosure. Previously, the owner's were willing to work with us and let us stay. We were able to negotiate no rent for a period of time to allow our family time to save for a new deposit. The current owner has a $500k home in Roseville, CA and owns his own business. He came to the house the other day and admitted to me he knew he was taking my money and not making his payments. He didn't want to go through another winter and possibly lose the house so he just let it go now.

RG09481107 Alameda County Superior Court Judge August 25, 2010, takes matter off calendar; Property Asset Management, Inc vs Brown. Attorney David Endres got the property from Pite and Duncan Trust Account where the Original Trustor from 2001 Lisa Swain-Morris employed at Charles Swabb had purchased the building in HUD Loan; it was found later that lead based paint current today was on the building and in the yard too. There was a lease signed with Brian Coleman and children and Ami Brown.

We have been renting a home in Carlsbad, CA since June 2008. The home is in foreclosure and scheduled for auction (2nd time in ten months) on 7/14/2010. With our original lease contract, we paid upfront first months rent, last months rent and a security deposit. Our landlord refuses to provide us with any written information or verification that she has or is able to postpone the auction. She says that she has a "verbal agreement" with the bank and has nothing in writing to offer us.

In the end of May 2010 i found the condo i live in on a foreclosure list...wow was i surprised. I deal with an manager not the owner so i asked him....he told me it was true & how did i feel about it? duh what a dumb question. I pay my rent every month and the owner pockets the money...it don't seem fair. So i do my research go to the county recorder's office, to my surprise my owner has not paid her morgage since Nov 2009...i moved in Oct 2009. So then i call the manager back and he then gives the owner my # she calls and says do not pay June's rent.

After several years of receiving notices that the home we rent was in foreclosure, we finally received official notice it had foreclosed. We have almost used up our 90 days and have been unable to locate a home to rent. I am working on getting my credit score up to purchase a home, but for now we need to continue renting. I have been unable to locate a suitable house for our family. I am not sure why, but there are not many homes currently for rent. We need a home with at least 4 bedrooms considering we have three children. When a home this size becomes available, it is quickly rented.

I learned on my own that my rental house is in foreclosure, asked landlord and the refused to answer. I'm holding the rent for April 2010 till they officially disclose it. Real Estate agent says sale date in June 7. I don't know where to pay the rent and who are real owner of the house. Landlord give me quit notice and submitted small claim notice that I didn't pay rent since January 1st, which is not true, they requested cash and I have been paying the rent till March. Landlord never give me quit notice before April because I paid the rent and now saying I didn't.

I moved into this home 2 months ago and paid a deposit and so far 2 months of rent come to find out our landlord is 5977.32 behind on her pmts which equal about 4 months worth of mortgage pmts. I dont know what to do next I dont think I will be paying till she resolves her problem with the bank.
