Eviction

In March of 2009 I rented an apartment at VintageWood in Fresno, California. I paid my monthly rent. I then graduated from the local University and began applying for work. I found two places of employment…on for three weeks and the other a distance from my apartment. I began to work at the second job and was gone from the apartment for 5 days at a time. My roommate was a young adult who was of age. He had friends who came to visit when I was out of town. I visited on my days off.

in october 2002, 6mos after meeting my boyfriend his parents asked us if we wanted to move into their house that they were moving out of since they were retiring. we were in an apartment at the time and agreed to move in. HUGE MISTAKE ON MY PART. ever since i have had problems with him and his family especially on ocasions when law enforcement was involved. being as it was his/his parents house, i was always the one who had 5 minutes to pack a bag and leave. on one occasion i had my own place for almost 2 years he would cause some drama and i was asked to leave.

HOA sold condo at trustee sale..then did not give any eviction notice. No 3 day or 30 or 60 day notice. They changed the locks when my daughter & I were not there twice. the took all of out possessions and refused to let us in for more than 20 minutes at a time..they kept us out by refusing to let us in thru the live security gates..

The actual owner of the property we stay at has recently suffered his third stroke. His "family", the individuals now claiming to care about his health and wellness effectively showed up to the property in Columbia, California FROM OREGON claiming to be the current "owners". The actual owner's son (one who has made very poor choices concerning his father and has had NO contact with him in over 6 years) called the local sherriff demanding that the three tenants currently residing at the home must go. His claim is owner occupation.

I am a 62 year old senior living with AIDS. After living in the heart of the Castro district in SF for four decades and in my apartment for over 18 years, I am going through the eviction process brought on by the new owners (real estate speculators)through the use of the Ellis Act and through no fault of my own. It is the owner's intention to renovate the building and resell it at a large profit.

I have been renting aforementioned property close to three years. I had a month to month lease agreement with the homeowner and paid my rent early/on time every month up to last August (2012) when I was informed by mail that the property was in foreclosure and would be up for public auction. At that point I informed the homeowner (his mail still comes here and I had his permission to open anything pertaining to rental property)On the legal advice of a family friend we were told to stop rental payments and sit tight.

For the last 6 months I've been paying my rent late and haven't been able to pay the late fees of $76. This new manager is very tough. She told me that this month they dont want partial payment they want all the fees wich is $2160.. When I calculated the $76 times 6 the total is $1951. Any way I havent been able to pay it due to my job crisis and health problems also. Saturday the 27th got court papers of eviction, I have no money to cover the legal fees. I could pay the rent amount for april but is totally impossible for me to pay extra fees. They seems to be on a non negotiable positon.

My landlords owned a nice house here in Newark, CA that they bought for $220K in 1999. They owed $176K and if they hadn't borrowed more, they would be close to paying it off. The bank got them to borrow more money to improve the house as the value "rose" during the bubble, and after 8 refinances with 3 different banks they owed $378K. They lost the house and I ended up renting it on a month-to-month agreement while they waited for the bank to foreclose.

Long story short. We are tenants who were evicted with a written unexpired lease in a property that was foreclosed on. We clearly have protections under PTFA 2009 and AB2610 but the orange county judges, sheriffs department, baNK Of america and safeguard and their attorneys have no respect or even care about the law.
