The Ellis Act was passed in 1985 to provide landlords with alternate means to get out of the rental business. However, the Act is primarily used by real estate speculators, which uses a loophole in the act to evict tenants and make windfall profits. The Ellis Act allows landlords to evict all the tenants in a building and give no-fault evictions to tenants even in just-cause jurisdictions. Buildings are usually then converted to condos, Tenancies in Common, or demolished. Use of the Ellis Act chips away at the affordable housing stock of communities and undermines local tenant protections.
