my wife nad I moved into our rental home in February, 2014. After a few weeks, our youngest daughter came over, with our pets, who were living with our daughter because this rental did not allow pets, when the gardener notice them and subsequently, informed the property manaegement company. We had informed the property manager of the property that the pets were over the home on this one particular day, however, the pets were not living with us in the residence. In a notice from them, a demand was made that the pets be removed from the home and that an inspection to confirm was necessary to confirm the pets were out of the residence. The final paragraph of ths notice indicated that the owner of the property would allow us to have the pets reside with us so long as we agreed to a $1000 pet security deposit and an additional $50 a month, pet rent. They requested various documents, of which we provided, along with the two payments. Several weeks later, they began to demand a "Pet Application" and a "Pet Application Fee" of $150, ($75 X 2), with an annual "Pet Renewal Fee" of $50 per pet. When I initially questioned the fee, my request went unanswered. Only after 7 weeks and two certified letters to them, did the owner replay via e-mail indicating he was under no legal obligation to explain his "Pet Fees", in the interim, they began adding these fees to my account and then deducting their fees from the rent I was paying each month, thereby making my rent appear deficient. At the same time they were making my rent payment deficient, they were adding "Late Rent" fees to my account. Now, as a resultof their's diversion of my rent funds, they are attmpting to evict us. I am led to believe that as a result of their acceptance, and presenting for payment of such, of the "Pet Security Deposit" and the monthly "Pet Rent", of which I have indicated on each of the two checks I send them each month, that the terms of acceptance of the pets at the residence have been accepted by them. If anyone can provide any laws or case studies that wouold supprot my position, any and all would be greatly appreciated.
